Punishment for Cyber Crime in India

Under The Information Technology (Amendment) Act, 2008, Cyber-terrorism is punishable with life imprisonment. Cyber offences such as identity theft, cyber-stalking, cyber harassment, spoofing and hacking are the punishable offences under this section. The IT (Amendment) Act, 2008 was passed by both Houses of Parliament on December 23, 2008.

It was notified after the assent of the President on February 5, 2009.but in the recent past the amendments have raised the quantum of fine involved, but reduced the punishment…that gives out a mixed signal. More than 1000 young boys are languishing in jails across India for cyber crime, 573 of them are under trials, 197 are under investigations, 14 hospitalised due to various reasons, 12 of them are convicted, and rest of the cases are under proceedings.

Maximum number of cyber criminals are arrested from north India. So far no human right actvists or social groups ever supported these criminals. Government has special reward package for Alert citizen for providing information about hackers.The irony is that cyber crime is new age crime, and there is no specific law or punishment is penned in constitution, most of the defense lawyers are criminal lawyers and their expertise in cyber crime is limited. The seriousness of offense in most of the cases is quite minor, such as hacking some rivals website, blog or email. Money transfer by hacking banks, hacking Government sites, and misusing official website data like heinous crime is rarely traced.

Dear Sir,
I am to state that somebody had access to my facebook account and make various shameful posts by using vulgar and serious words. I dont know whether it is hacked or so? Please tell me any laws ie. IPC/ Constitution under which they can be registered for FIR or punished!

Sir my fb was hacked by someone i tried evarything to get it back but there is no use.in that fb my personals are having.that hacker used all those pics and he abused those pics .please help me to del that account

Sir i m a student of 12 class and wants to tell i that one of boy named lavnish posted wrong things about my frnd and she is a girl i respect her so i requested that boy to plz delete that post so further no one can see it becuz its been a insult of that girl he disagreed and started abusing me nd i contact through an hacker and deleted that post from his account and smehow that boy comes to know what i did and he was haarasing me by saying that its a cyber crime nd u will be in jail for 2 3 years
What should i do now i knw its a mistake by me but i was just helping a girl
Plzz help me out for this situation ...

Respected All,
It is correct that cyber criminals needs to be punished but expressing your views through email or right to publish any thing through email is also a crime. Publishng wrong information through emailmay be crime, but what about right information. Question comes how one can prove the matter published is right or wrong, for it it needs to verify the data published. If any information published through this medium is right then the publisher need not be punished.

It is good to see that India take tougher action against cyber criminals. Does the punishment only apply to average Indian citizen? What about film producer Karan Johar and actor Shahrukh khan and Gauri? They hacked into my friend's computer, her mobile phone and her bank account. They are stalking, harassing and bullying my friend since 2005. They control her pc and read her private emails like their own. The bullying was so intense my friend suffered a stroke but STILL they won't leave her alone. To date she is subject to their cruelty and is in danger of losing her bread and butter. They are pathetic and pure evil. They are hiding their crime in the name of busy life style. When Indian government will crack down on serious and serial criminals like Karan Johar, Shahrukh Khan and Gauri?
